Difficult Subject Attempt Documentation
How process servers document difficult attempts with observable facts, times, and access notes. No confrontation and no labels without support.
A hard visit still has to read as a clean record. Write what you saw and heard. Do not turn the note into a theory about the person. Describe conduct, not character Neutral language lasts. “No answer after two knocks. Television audible. Silver sedan in the driveway, tag not recorded.” That is a note. “Subject is evasive” is a label. Use the first unless the file already gave you a fact that supports the second. Put these observations in the record Date and time. Vehicles present. Lights on or off. Sounds from inside. Any conversation, quoted as closely as you can. Access conditions: gate, dog, posted hours, a neighbor who spoke. Address indicators: mailbox name, unit plate, a directory listing. If someone spoke, write what they said about occupancy or identity. If they did not, write that no one answered. Either way, the next reader should be able to stand at that door from your words. Do not call someone evasive without facts A closed door is not evasion. A refused name is not evasion. If a person walked away after you identified yourself, write that sequence. Counsel can decide what it means. You supply the sequence. No confrontation, threats, or pursuit Do not argue the case, threaten anyone, promise surveillance, or follow a person in a way that puts you or them at risk. Identify yourself, keep the talk short, and leave when the visit is over. PPS Serve does not want a completed serve that came from a fight in a driveway. When to stop and contact dispatch Stop if you feel unsafe, if someone tells you to leave, if a dog or a crowd makes the door unreachable, or if the location does not match the file. Contact dispatch the same day with the facts. Do not make a second plan on your own. Should I wait in the street to see if someone comes home? Do not sit on a house. Complete the attempt you were sent to make, write the note, and ask the office about another window if one is needed. What if a neighbor offers a story? You may record a short, attributed comment. Do not treat it as proof of identity or as a new address unless the office authorizes that address.
